1. GENERAL ASPECTS

The following are the terms and conditions that specify the rules and regulations for access to and use of the mamasmateas.com website, hereinafter interchangeably referred to as the “Site”, “Mamás Mateas”, “mamasmateas.com”, “Company”, as well as for any type of information, content, image, video, audio or other material communicated or present on the mamasmateas.com website.

Access and use of this website, that is, visits, possible contracts and transactions that the user, hereinafter indistinctly the "Client", "Buyer", "Consultant" or "User", carries out within the Mamás Mateas website, as well as its legal effects, are subject to the terms and conditions described here and to the laws and jurisdiction of the Republic of Chile, especially Law 19,496 on the protection of consumer rights.

Mamás Mateas will therefore strictly apply all the benefits, guarantees and rights recognized in favor of consumers in Law 19,496. In addition, Mamás Mateas adheres in all its parts to the Code of Good Practices for Electronic Commerce of the Santiago Chamber of Commerce, which is available at the following link .

The terms and conditions described herein shall be deemed accepted and known by the User upon entering the site. In order to use and make a purchase or any type of action or transaction through the Site, it is a mandatory requirement that the Client accepts these Terms and Conditions, by declaring that Mamás Mateas has informed him/her clearly, comprehensibly and unequivocally of them.

The User is advised to read these terms and conditions carefully and to keep a printed or digital copy of everything specified here for their safety.

2. COMMUNICATIONS

In order for the User to be able to communicate with Mamás Mateas, whether it is a query or complaint regarding the use and access to the site, possible contracts and transactions carried out by the Client, as well as for all legal purposes, Mamás Mateas SpA designates as special representative Ms. Catarina Parra, RUT 23.383.124-7 General Manager, available at the email shop@mamasmateas.com; and at the Customer Service telephone number +56 9 4269 0488 (business hours Monday to Friday from 9:00 a.m. to 5:00 p.m.).

Mamás Mateas undertakes that if it sends you advertising or promotional information by email, it will contain at least the following information:

  1. Identification of the message, making it recognizable as advertising or promotional communication, in the subject field of the message.
  2. Existence of the right of the consumer or user to request the cessation of sending advertising of this type by Mamás Mateas and the obligation of Mamás Mateas to suspend such sending.
  3. A simple and effective procedure for the consumer to make this request, indicating an electronic address for this purpose.
  4. The advertiser's identification with its commercial name.

Mamás Mateas will cease sending advertising or promotional messages by email or other equivalent means of individual communication to any person who has expressly requested the suspension of such messages.

3. PROCEDURE FOR USING THE MAMASMATEAS.COM SITE

Mamás Mateas will keep the User informed of all the steps to follow to carry out any type of transaction through the Site, whether for the contracting of its services or for the acquisition of the products offered on the Site.

To make a purchase* or acquire a product through this Site, the User must follow the following steps:

  1. Having read and accepted the Terms and Conditions.
  2. Log in to the site with your username and password or as a guest if you have not yet registered.
  3. Select the product(s) of your interest and add them to the “shopping cart”.
  4. Once you have completed the selection process, go to the Shopping Cart. You can leave a note if necessary. After that, press “Proceed to checkout”.
  5. The form will then appear with your contact information if you are purchasing as a guest, or you can log in if you already have an account or create one.
  6. Select the delivery method.

If you have chosen “Pickup” you can pick up your products from Monday to Sunday at the selected store, as long as you have received the confirmation email (this can be up to 4 business days after the purchase).

If you have chosen “Send” you must fill in the following information: email, shipping address, name and surname, full address, postal code, commune, region, country and telephone number. When you finish, you must press “Continue with shipments”.

Once this is done, the total amount to be paid will be calculated and displayed. If you agree, press “Continue with payment”.

  1. Select the payment method, complete the “Billing address” form and press “Complete order”.
  2. You will be directed to Mercado Pago where you can choose to pay with your credit or debit card to complete your purchase and, once you have paid, you will receive a confirmation email and the receipt, which is proof of your purchase.

All orders are shipped the next business day after purchase and delivery times may vary.

* There is no minimum age for purchasing products, unless a particular product indicates otherwise.

The purchase of products and/or contracting of services from Mamás Mateas will be effective once payment has been approved and subsequently with the sending of confirmation via email.

4. RIGHTS OF USERS OF THE MAMASMATEAS.COM SITE

The User enjoys all the rights granted to him/her by the legislation on consumer protection in force in the territory of Chile, as well as those granted to him/her in the terms and conditions described herein.

5. REGISTRATION

Registration on the mamasmateas.com site and the use of a password is not a mandatory requirement for contracting, however it facilitates personalized, confidential and secure access to the Site.

If you register on the Site, you will be given a secret password that you can access and even change if you so require. To activate the password, you must complete the registration form available on the Site and send it to Mamás Mateas by clicking on the corresponding field.

The user and administrator will be responsible for the confidentiality of the password within the scope that corresponds to each one.

6. PROTECTION OF PERSONAL DATA AND SECRET KEY OF THE MAMÁS MATEAS USER

The Client may have the right to information, rectification and cancellation of personal data in accordance with the laws on personal data protection in force in the territory of Chile. Mamás Mateas will use the data provided by the User to enter into contracts for the sale of products and services offered on the Site, receive the corresponding payments and make deliveries. Mamás Mateas will not provide personal data to third parties that are not related to the company.

Users' Responsibility for Information Registered on the Site:

Mamás Mateas will adopt the necessary and prudent measures to safeguard the security of the data and secret key, such as information encryption systems, security certificates or others that the company deems appropriate.

By entering personal data, the User guarantees that the information they provide for the conclusion of the contract is true, complete, accurate and up-to-date.

Mamás Mateas is not obliged to confirm the information provided by Users. Therefore, it will not be liable for damages or losses arising from the inaccuracy of the information provided by Users.

Users are solely responsible for the loss, misuse or unauthorized use of the validation code, whether by themselves or by third parties, after the purchase has been made in the manner expressed in the Terms and Conditions.

Personal data:

In accordance with Law 19.628, the personal data provided on the Website will become part of a Mamás Mateas database and will be used solely and exclusively for the purposes for which they were provided and especially for general communication between the Company and its Clients, validating the purchase data, arranging the delivery and answering your queries. The data will not be communicated to other companies without the express authorization of its owner nor will it be transferred internationally.

Mamás Mateas never requests personal or financial information via email, except in the case where the User requests a refund of the amount paid for a purchased product. In this case, Mamás Mateas may request the bank account number in order to make the refund via bank transfer ( if this is the payment method used to make the purchase ).

Mamás Mateas assumes that the data has been entered by the owner or by a person authorized by the owner, and that it is correct and accurate. By accepting these Terms and Conditions, Users declare that the personal data they provide through the online forms on the Mamás Mateas website may be used for subsequent Offers different from those offered on the Site.

Without prejudice to the foregoing, Mamás Mateas guarantees users the free exercise of their rights to information, modification, cancellation and blocking of their personal data established in Law 19,628. Therefore, buyers may make requests related to said rights, and within a maximum period of two calendar days, Mamás Mateas must respond and effectively implement this request.

Electronic Documents:

The User, in his/her capacity as manual recipient of electronic documents, in accordance with Exempt Resolution No. 11 of February 14, 2003 of the Internal Revenue Service (which establishes the procedure for taxpayers authorized to issue electronic documents to also send them by these means to manual recipients), declares and accepts the following:

By approving these Terms and Conditions, the User authorizes the company MAMÁS MATEAS SpA Y 77.150.567-8, to deliver the corresponding tax document for this transaction only by electronic means. Likewise, the User authorizes that the notice of publication of the tax document be sent to him/her by email.

In accordance with the indicated regulations, and in the event that the User requires it to support the accounting information, he/she assumes the following obligations in relation to said tax documents:

  1. Print the documents received electronically, for each tax period, immediately upon receipt from the issuer.;
  2. Print the document in the size and form in which it was generated;
  3. Use white original-type paper with a minimum size of 21.5 cm x 14 cm (1/2 letter) and a maximum size of 21.5 x 33 cm (legal);
  4. Print in a quality that ensures the document remains legible for a minimum period of six years, as established by current legislation on the subject. This printing will be done using laser or inkjet printing, unless a different authorization or regulation is established in this regard.

7. EXCHANGE AND RETURNS OF PRODUCTS OFFERED ON THIS SITE

All your Mamás Mateas purchases have 10 days for money returns and 30 days for exchanges (does not apply to hygiene products, personal care and diapers) from the date of purchase.

To exchange a product, the Customer has 30 days from the date of purchase to submit their request through mamasmetas.com.

To request a refund of the amount paid for the purchase of a product, the Customer has 10 days to request said refund from the date of purchase.

The refund of the amount paid will be made to the payment method used for the purchase and we will request your current account in the case of bank transfers. The refund may take up to 15 business days from when we receive the products, since we must carry out their evaluation and then proceed with the refund.

The refund of the amount paid for the delivery of an order only applies to those purchases cancelled before being sent. The shipping refund will not apply to orders that have been sent and for which the cancellation of delivery has been requested later.

Exchanges and returns do not apply to hygiene products and diapers. 

1. Online Shopping

Changes and Returns:

  • To exchange or return an online purchase, the Customer must go to the "Exchanges and Returns" section on the mamasmateas.com website and complete the corresponding form, or can carry out the process directly in any of our physical stores.

Home Pickup or Office Delivery:

  • Changes and returns can be made with the Mamás Mateas order number (prefix MM) found in the purchase confirmation email (sender shop@mamasmateas.com ). In the case of gifts, you must select the option "Do you want to change a gift?".
  • In order for us to make the exchange or return, the products must have been purchased at mamasmateas.com, be in their original packaging, unused, with their original labels, accessories and without damage. It is crucial that the labels and boxes are not damaged.
  • The cost of the home pick-up service in the RM or shipping of the product to the Warehouse through a logistics operator is the responsibility of the customer, as is the new shipment in case of changes.
  • Once the request for change or return is submitted, the authorization and approval process will take between 24 to 48 hours.
  • All changes and returns will be approved once our quality control has confirmed that all the aforementioned specifications are met.
  • Refunds may take up to 15 business days from the time we receive the products. After evaluating the condition of the product and accepting the conditions, we will proceed with the refund.
  • The refund of the amount paid for the delivery of an order only applies to those purchases cancelled before being sent. The shipping refund will not apply to orders that have been sent and for which the cancellation of delivery has been requested later.

2. Shopping in Stores

Changes and Returns:

  • To make an exchange or return, the Customer must complete the process in any of our physical stores.
  • The Customer must present the purchase receipt, exchange ticket or invoice in order to make the exchange and/or return.
  • Products must be in their original packaging, unused, with their original labels, accessories and undamaged.
  • In the case of a refund, this will be made to the payment method with which the purchase was made.
  • Exchanges can only be made for products available in the store where the process is being carried out.
  • No exchanges will be made in store for products only available on the mamamateas.com website.

3. Important Information for Any Exchange or Return Channel

  • The exchange period is 30 days from the date of purchase and the Customer must have the exchange receipt or ticket (in the case of gifts).
  • The deadline to request a refund is 10 days from the date of purchase (except in warranty cases).
  • Only two changes can be made within 30 days of the ticket being issued; after the second change, no more changes can be made.
  • Changes are subject to stock availability in physical and online stores.
  • For voluntary returns or exchanges, products must be returned as new, unused, with all their original packaging and in perfect condition, including warranty certificates, user manuals, accessories and promotional gifts associated with the purchase.
  • The refund will be made to the payment method used for the purchase. We will request the current account in the case of bank transfers.
  • If an electrical, furniture or mobile product has any fault or factory defect, the exchange/return process must not be carried out in person at Mamás Mateas stores. It must be notified to the contact emails ( shop@mamasmateas.com I hola@mamasmateas.com ) to be evaluated by technical service. Some of the products considered for this exception are:
    • Beds
    • Cribs
    • Dining Chairs
    • Breast milk extractors
    • Rocking Cars
    • Cars
    • Car Seats
  • Gift cards cannot be refunded for cash.

4. Additional Information

  • The process of receiving and approving an exchange and/or return can take up to 15 business days from when we receive your product.
  • For exchanges/returns of purchases made in Mamás Mateas stores, they can only be made at any of our branches within 30 days of the purchase, presenting the receipt or exchange ticket (in the case of gifts).
  • The refund of the amount paid for the delivery of an order only applies to those purchases cancelled before being sent. The shipping refund will not apply to orders that have been sent and for which the cancellation of delivery has been requested later.
  • Refunds may take up to 15 business days from the time we receive the products. Once the product(s) arrive at the warehouse, we carry out the evaluation and then, if the product's conditions are accepted, we proceed with the refund.
  • For exchanges or returns of Mamás Mateas brand products purchased through distributors, the customer must contact the purchase site directly.

8. RIGHT OF WITHDRAWAL

The user may not withdraw from the contract entered into on this site, unless a particular service or product expresses the possibility of withdrawal.

 

9. LEGAL WARRANTIES

If the product does not have the technical characteristics reported, if it is damaged or incomplete, it may be exchanged immediately. If it presents faults or defects within 6 months from the date it was received, the customer may choose between free repair, or prior restitution, exchange or refund of the amount paid, provided that the product has not been damaged by an act attributable to the consumer. For such purposes, the Customer must present a receipt or exchange ticket, and the product with all its accessories.

If the product has a manufacturer's warranty, the term of this warranty will apply, if this term is longer.

All of these periods will be suspended for the time that the item is being repaired under the warranty, and until the repair is completed.

The following will be considered a failure or defect:

  1. Products subject to mandatory safety or quality standards that do not meet specifications.
  2. If the materials, parts, pieces, elements, substances or ingredients that constitute or integrate the products do not correspond to the specifications they bear or to the mentions on the label.
  3. Products that, due to deficiencies in manufacturing, processing, materials, parts, pieces, elements, substances, ingredients, structure, quality or sanitary conditions, where applicable, are not entirely suitable for the use or consumption for which they are intended or for which the supplier has indicated in their advertising.
  4. If the supplier and consumer have agreed that the products subject to the contract must meet certain specifications and this does not occur.
  5. If after the first time the guarantee has been made effective and the corresponding technical service has been provided, the deficiencies that make the product unfit for the use or consumption referred to in numeral 3 persist. This right will continue to exist in the event of a deficiency that was the subject of the technical service, or if the same deficiency occurs again.
  6. If the item that is the object of the contract has defects or hidden flaws that make it impossible to use it for its normal intended purpose.

10. PAYMENT METHODS

The services and products offered on this Site may be paid through the Mercado Pago portal using the following methods:

  1. Bank credit cards issued and authorized for consumption in Chile. The company may indicate certain purchase conditions depending on the payment method used by the User.
  2. Bank debit cards issued in Chile by national banks, which maintain a valid contract for such purposes with the Payment portal.
  3. PayPal is only available for international payments (outside Chile) for the Online Sleep Course for Newborns 0 - 4 months. If the User is purchasing said course outside Chile, they can choose this payment method. The order will be pending and Mamás Mateas will send a PayPal payment link (in USD = 55 USD) via email to complete the purchase.

Users declare that they understand that these payment methods or payment portals belong to third-party companies that provide these services, independent and not linked to Mamás Mateas, so the continuity of their provision of services over time, as well as the correct functioning of their online payment tools and buttons, will be the exclusive responsibility of the companies that provide these services and in no case of Mamás Mateas.

If other payment methods are enabled, these will be reported through the corresponding channels.

11. DELIVERY AND DISPATCH OF PRODUCTS

The delivery and dispatch of the products purchased through this Site will be subject to the conditions reported on mamasmateas.com. for this purpose. All information regarding the shipping location or address provided for the dispatch and delivery of the products is the exclusive responsibility of the User.

Shipping Policy

- SHIPPING COVERAGE

Normal Dispatch: Operated by Blue Express, it covers all of Chile. In the extreme northern and southern regions, we offer two options: Land and Air shipping. Usually the delivery time for this shipping method is 6 business days or less in the RM and from 1 to 15 business days to Regions (shipping times may vary by product and you can see it in the information of each one, and in the cart at the time of purchase on mamasmateas.com)

Express Shipping: Delivery in less than 3 hours to the following communes: Huechuraba, Vitacura, Recoleta, Conchalí, Providencia, Independencia, Santiago, Ñuñoa, La Reina, Vitacura, Las Condes, La Reina, Providencia, Recoleta and Lo Barnechea. Available from Monday to Sunday and holidays (except non-waivable ones) from 10:00 to 18:00. Important: Choose Express Shipping ⚡️ when paying.

Free Shipping: Corresponds to Normal Dispatch operated by Blue Express.

This option will only be valid under the following conditions:

- Metropolitan Region
For purchases over $60,000

- Regions
For purchases over $120,000

Customer Responsibility: The customer must select the shipping method. If the Express Shipping option is not available, it means that the selected products do not qualify for this option.

- DELIVERY TIMES

Delivery times vary depending on the product and the type of shipping chosen. The bill starts from the confirmation of payment.

Orders with Multiple Products: For orders with different delivery times, the longest delivery time will be applied as the delivery limit. For example: if you buy a baby bottle that has a delivery time of 1 to 72 business hours and a breast pump that has a delivery time of 6 business days or less, the delivery time for your order will be 6 business days or less.

Separate Offices: Some orders can be divided into two different shipments , which will be specified in the shopping cart.

Tag Arrives Today: If the delivery commune and the product you want to buy have the label “Arrives Today”, the order will arrive the same day. Valid from Monday to Sunday and holidays (except non-waivable ones) from 10:00 to 18:00. After this time, the label will change to “Arrives Tomorrow” and the order will be delivered the next day. This delivery option will only be valid if the shipping method chosen was Express Shipping ⚡️ at the time of payment.

Management Responsibility: The customer must provide a valid address for receipt of the order. Delays due to absence of the customer, incorrect data, refusal to accept the shipment or change of address are not the responsibility of Mamás Mateas. These cases will require a new payment to coordinate the reshipment.

    - Product recall:

    Withdrawal Option: Available after receiving confirmation email and/or SMS (may take up to 4 business days after purchase).

    Withdrawal period: Maximum of 14 calendar days after notification. After this period, the order will be cancelled and the products will return to stock.

    - PRE-SALE

    Pre-Order Products: If a product is labeled "Pre-order", the shipping date is indicated in the description of that product. In cases of orders with available and pre-order products, the available products are shipped according to the established deadlines and then the pre-order orders are shipped according to the deadlines indicated in the products. For example: If you buy a Mini Rest that has a delivery time of up to 6 business days and a car that is on pre-order with delivery for 1 more month, the Mini Rest is shipped and in one more month the car will be shipped.

    - SHIPPING COSTS

    Calculation: It depends on the address and weight of the order. They are calculated in the shopping cart based on the customer's information and selected products.

    12. DATA VALIDATION

    Mamás Mateas may contact Users by email or telephone to verify their data and, if necessary, to try to prevent possible fraud in the event of any irregularity in the transactions made by the customer through this Site. The purchase order may be rejected if the Company has not been able to contact the User within 24 hours after making the purchase on the Site.

    13. SCOPE OF THE CONDITIONS REPORTED ON THIS SITE

    Mamás Mateas will not modify the conditions under which the User has entered into a contract or transaction on this Site. The prices of the products and services will be available as long as they appear on the Site. However, the company reserves the right to modify the information, including that relating to the products and services, their prices, stock and conditions, at any time and without prior notice until receiving acceptance and confirmation of the transaction made by the User.

    The prices of services and products are applicable to the delivery and dispatch address. The company may make changes to the final purchase price if the User makes a change in the city or commune of the delivery location according to the shipping costs of the new address.

    14. COMPANY RESPONSIBILITY

    Mamás Mateas is committed, to the best of its ability, to ensuring that the Site operates error-free. However, the Company cannot guarantee optimal conditions on its own given the nature of the digital ecosystem and the Internet. This is why the User's access to his or her account or during a transaction may occasionally be restricted or present errors.

    The Company will inform the User of the email address and the technical means available to verify and correct errors in the delivery or in the User's data once the User has made a purchase or transaction. These obligations will be deemed fulfilled by the User following the steps indicated on the Site to make a particular purchase.

    15. LIMITATION OF LIABILITY

    Mamás Mateas cannot guarantee that this site and any documents, files and information hosted on or downloaded from this Site will not contain viruses, trojan horses, worms, time bombs, keystroke loggers, spyware, adware and other harmful programs or computer code designed to adversely affect the operation of any computer software or hardware; The company will not be liable for any type of loss that the User may suffer, arising from such harmful code or computer code.

    Links to other sites are provided for informational purposes only. This site is not responsible for the operation or content of a link to a site outside of this site. Therefore, Mamás Mateas is not responsible for the material on external links or any loss or damage that may arise from using them.

    In no case will Mamás Mateas be liable for:

    1. The improper use that Users or visitors of the Site may make of the materials displayed, of industrial property rights and of intellectual property rights.
    2. Damages or possible losses that may be caused to Users by the operation of the search tools and errors generated by the technical elements of the Site or search engine.
    3. Contents of the pages that Users can access with or without authorization from Mamás Mateas.
    4. Access by minors or persons without capacity, under the terms of the corresponding legislation, to the contents adhering to the contractual relationship arising from the Site.
    5. Loss, misuse or unauthorized use of your validation code, whether by the User or third parties, after the purchase has been made in the manner expressed in the Terms and Conditions. Likewise, the parties recognize and record that the computer platform provided by Mamás Mateas is not infallible, and therefore, during the term of this Contract, circumstances beyond the control of Mamás Mateas may occur, which imply that the Site or the computer platform are not operational for a certain period of time.
    6. Information about Mamás Mateas or its services found on sites other than www.mamasmateas.com 

    In such cases, Mamás Mateas will endeavour to restore the Site and the computer system as quickly as possible, without any liability being attributed to it.

    Mamás Mateas does not guarantee the availability and continuity of the operation of the Site, nor that at any time and place, Users can access the promotions and Offers of the Site.

    Mamás Mateas is not responsible for viruses or other elements in electronic documents stored in the Users' computer systems.

    Mamás Mateas will not be liable for any damages caused to the Client resulting from the inappropriate use of the technologies made available to the Client, regardless of the manner in which these technologies are inappropriately used.

    Mamás Mateas will not be liable for damages caused to the Site by improper and bad faith use by Users. However, in the event of a double payment being made by a User on the Site, Mamás Mateas will return the overpayment within 3 days following receipt of the respective written claim from the User or Buyer, in which the originals of the receipts for the additional payment to the purchased item are attached.

    In Login, registration and communication with payment companies, Mamás Mateas uses digital security certificates (SSL) in order to encrypt communication. Mamás Mateas does not manipulate or store financial data of its customers.

    In any case, Mamás Mateas' liability, whether contractual, extra-contractual or legal, with the Users or visitors of the Site shall not exceed the price actually paid by the Buyer in consideration for the product or service, without prejudice to what is determined by the Courts of Justice.

    16. PROMOTIONS

    All promotions that offer a reduction in the price of a product or service, as well as free shipping, will be sent and delivered to the same place or address to which the purchased product is shipped. If the User, upon accepting the offer, requests that one or more products be delivered to a different address than the one indicated, the Customer must pay the shipping cost corresponding to each product. The promotions will be valid under the conditions estimated in the offer and the User may benefit from them as long as they comply with said conditions.

    17. INTELLECTUAL AND INDUSTRIAL PROPERTY

    All texts, images, logos, distinctive signs, sounds, animations, videos, source codes and other content included in this site are the property of Mamás Mateas or its content providers, and are protected by Chilean and international intellectual property laws. Therefore, Mamás Mateas has, where applicable, the right to reproduce them and, in this sense, they constitute assets protected by current and applicable intellectual and industrial property legislation.

    The graphic materials, logos, page headers, advertising phrases, button icons, written texts and names of services included in this site are trademarks, creations or commercial images owned by Mamás Mateas in Chile and other countries.

    Such trademarks, trade dress and trade dress may not be used in connection with any product or service that is likely to cause confusion among Customers, or in any manner that disparages or discredits Mamás Mateas. Other trademarks not owned by Mamás Mateas that appear on this Site are the property of their respective owners.

    All rights not expressly granted in these Terms and Conditions are reserved by Mamás Mateas or its licensors, suppliers, publishers, rights holders or other content providers. No products, images or sounds may be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any purpose, in whole or in part, without the prior written consent of Mamás Mateas.

    You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Mamás Mateas without its express written consent.     These Terms and Conditions are governed by the laws of the Republic of Chile. Any conflict or controversy between the User and the Company arising from the use of this site and in relation to the interpretation and compliance with these Terms and Conditions shall be subject to the jurisdiction of the corresponding courts.

    Mamás Mateas may modify the Terms and Conditions described here at any time, making them public on this Site. It is the responsibility of the User, once he/she enters mamasmateas.com, to have read these Terms and Conditions. And his/her acceptance will be deemed to be acknowledged by the fact of making use of this Site.

    XIX.  VALIDITY AND EFFECTIVENESS OF THE TERMS AND CONDITIONS

    These terms and conditions were last updated on Friday, August 4, 2023.

    1. SHIPPING COVERAGE

    Normal Shipping: Operated by Blue Express, it covers all of Chile. In the extreme northern and southern regions, we offer two options: Ground and Air shipping. Usually, the delivery time for this shipping method is 6 business days or less in the RM and 1 to 15 business days to Regions (shipping times may vary by product and you can see it in the information for each of them, and in the cart when making the purchase on mamasmateas.com)

    Express Shipping: Delivery in less than 3 hours in the following communes: Huechuraba, Vitacura, Recoleta, Conchalí, Providencia, Independencia, Santiago, Ñuñoa, La Reina, Vitacura, Las Condes, La Reina, Providencia, Recoleta and Lo Barnechea. Available from Monday to Sunday and holidays (except non-waivable ones) from 10:00 a.m. to 6:00 p.m. Important: Choose Express Shipping ⚡️ when paying.

    Free Shipping: Corresponds to Normal Shipping operated by Blue Express.

    This option will only be valid under the following conditions:

    - Metropolitan Region
    For purchases over $60,000

    - Regions
    For purchases over $120,000

    Customer Responsibility: The customer must select the shipping method. If the Express Shipping option is not available, it means that the selected product(s) do not qualify for this option.

    Important: Business days are considered to be Monday to Friday, excluding holidays. Shipments via Bluexpress are made from the business day following the purchase.

    2. DELIVERY TIMES

    Delivery times vary depending on the product and the type of shipping chosen. The bill starts from the confirmation of payment.

    Orders with Multiple Products: For orders with different dispatch times, the longest time will be applied as the delivery limit. For example: if you buy a baby bottle that has a delivery time of 1 to 72 business hours and a breast pump that has a delivery time of 6 business days or less, the delivery time for your order will be 6 business days or less.

    Separate Shipments: Some orders may be divided into two separate shipments , which will be specified in the shopping cart.

    Arrives Today Label: If the delivery commune and the product you want to buy have the “Arrives Today” label, the order will arrive the same day. Valid from Monday to Sunday and holidays (except non-waivable ones) from 10:00 a.m. to 6:00 p.m. After this time, the label will change to “Arrives Tomorrow” and the order will be delivered the next day. This delivery option will only be valid if the chosen shipping method was Express Shipping ⚡️ at the time of payment.

    Address Responsibility: The customer must provide a valid address for receiving the order. No shipments are made to branches or offices of Postal services . Delays due to customer absence, incorrect data, refusal to accept the shipment or change of address are not the responsibility of Mamás Mateas. These cases will require a new payment to coordinate the reshipment.

    Delivery Cancellation: Once notification has been received that the order has been prepared and dispatched, the purchase cannot be cancelled and the delivery cancellation must be requested by emailing shop@mamasmateas.com.

    3. STORE PICKUP

    Withdrawal Option: Available after receiving confirmation email and/or SMS (may take up to 4 business days after purchase).

    Withdrawal Period: Maximum of 14 calendar days after notification. After this period, the order will be cancelled and the products will return to stock.

    4. PRE-SALE

    Pre-Order Products: If a product has the "Pre-Order" label, the shipping date indicated in the description of that product. In cases of orders with available and pre-order products, the available products are shipped according to the established deadlines and then the pre-order orders are shipped according to the deadlines indicated in the products. For example: If you buy a Mini Rest that has a delivery time of up to 6 business days and a car that is on pre-order with shipping for 1 more month, the Mini Rest is shipped and in one more month the car will be shipped.

    5. SHIPPING COSTS

    Calculation: It depends on the address and weight of the order. They are calculated in the shopping cart according to the customer's information and selected products.

    Exchanges and returns.

    All your Mamás Mateas purchases have 10 days for money returns and 30 days for exchanges (does not apply to hygiene products, personal care and diapers) from the date of purchase .  

     

    We give you 3 options to exchange or return a product you bought online at mamasmateas.com:

    1. We will pick it up at your doorstep (available only for the RM* communes).

    2. You can drop it off at the nearest logistics operator office (you will receive the shipping label so you can dispatch the product).

    3. You can exchange or return it directly in any of our physical stores for products available there.

    Important: If your product does not meet the characteristics specified in our policies (it must be in its original packaging, unused, with its original labels and undamaged boxes), your request will be rejected and you will have to pay for new shipping .

     


    Terms and Conditions

    1. Online Shopping

    Changes and Returns:

    • To exchange or return an online purchase, the Customer must go to the "Exchanges and Returns" section on the mamasmateas.com website and complete the corresponding form, or can carry out the process directly in any of our physical stores.

    Home Pickup or Office Delivery:

    • Exchanges and returns can be made using the Mamás Mateas order number (prefix MM) found in the purchase confirmation email (sender shop@mamasmateas.com ). In the case of gifts, the option "Do you want to exchange a gift?" must be selected.
    • In order for us to make the exchange or return, the products must have been purchased at mamasmateas.com, be in their original packaging, unused, with their original labels, accessories and without damage. It is crucial that the labels and boxes are not damaged.
    • The cost of the home pick-up service in the RM or shipping of the product to the Warehouse through a logistics operator is the responsibility of the customer, as is the new shipment in case of changes.
    • Once the request for change or return is submitted, the authorization and approval process will take between 24 to 48 hours.
    • All changes and returns will be approved once our quality control has confirmed that all the aforementioned specifications are met.
    • Refunds may take up to 15 business days from the time we receive the products. After evaluating the condition of the product and accepting the conditions, we will proceed with the refund.
    • The refund of the amount paid for the delivery of an order only applies to those purchases cancelled before being sent. The shipping refund will not apply to orders that have been sent and for which the cancellation of delivery has been requested later.

    2. Shopping in Stores

    Changes and Returns:

    • To make an exchange or return, the Customer must complete the process in any of our physical stores.
    • The Customer must present the purchase receipt, exchange ticket or invoice in order to make the exchange and/or return.
    • Products must be in their original packaging, unused, with their original labels, accessories and undamaged.
    • In the case of a refund, this will be made to the payment method with which the purchase was made.
    • Exchanges can only be made for products available in the store where the process is being carried out.
    • No exchanges will be made in store for products only available on the mamamateas.com website.

    3. Important Information for Any Exchange or Return Channel

    • The exchange period is 30 days from the date of purchase and the Customer must have the exchange receipt or ticket (in the case of gifts).
    • The deadline to request a refund is 10 days from the date of purchase (except in warranty cases).
    • Only two changes can be made within 30 days of the ticket being issued; after the second change, no more changes can be made.
    • Changes are subject to stock availability in physical and online stores.
    • For voluntary returns or exchanges, products must be returned as new, unused, with all their original packaging and in perfect condition, including warranty certificates, user manuals, accessories and promotional gifts associated with the purchase.
    • The refund will be made to the payment method used for the purchase. We will request the current account in the case of bank transfers.
    • If an electrical, furniture or mobile product has a fault or manufacturing defect, the exchange/return process must not be carried out in person at Mamás Mateas stores. The contact emails ( shop@mamasmateas.com and/or hola@mamasmateas.com ) must be notified so that they can be evaluated by technical service. Some of the products considered for this exception are:
      • Beds
      • Cribs
      • Dining Chairs
      • Breast milk extractors
      • Rocking Cars
      • Cars
      • Car Seats
    • Gift cards cannot be refunded for cash.

    4. Additional Information

    • The process of receiving and approving an exchange and/or return can take up to 15 business days from when we receive your product.
    • For exchanges/returns of purchases made in Mamás Mateas stores, they can only be made at any of our branches within 30 days of the purchase, presenting the receipt or exchange ticket (in the case of gifts).
    • The refund of the amount paid for the delivery of an order only applies to those purchases cancelled before being sent. The shipping refund will not apply to orders that have been sent and for which the cancellation of delivery has been requested later.
    • Refunds may take up to 15 business days from the time we receive the products. Once the product(s) arrive at the warehouse, we carry out the evaluation and then, if the product's conditions are accepted, we proceed with the refund.
    • For exchanges or returns of Mamás Mateas brand products purchased through distributors, the customer must contact the purchase site directly.

    Legal Guarantee:

    If the product you purchased has a fault, you are entitled to the legal guarantee. This means that you have 6 months to request the exchange of the product, free repair or a refund. You must present your receipt or exchange ticket and the product with all its accessories.

    1. Descripción del Programa

    El Programa de Puntos del Club Mamás Mateas es un sistema de fidelización creado para premiar a nuestros clientes con puntos por sus compras en Mamás Mateas, tanto en la tienda online (www.mamasmateas.com) como en la tienda física. Los puntos acumulados pueden canjearse por crédito en tienda o por productos seleccionados según la disponibilidad y estrategia comercial.

    Al unirte al programa, aceptas estos términos y condiciones.


    2. Inscripción en el Programa

    • La membresía es gratuita y está disponible para cualquier persona mayor de edad con una cuenta registrada en Mamás Mateas.
    • La inscripción es automática al realizar una compra con un correo registrado, tanto online como en tienda física.
    • También puedes inscribirte completando el formulario disponible en nuestra web.
    • Cada cuenta es personal e intransferible.


    3. Acumulación de Puntos

    • Se otorga 1 punto por cada CLP $1 gastado en compras en Mamás Mateas.
    • Los puntos solo se acumulan si la compra se realiza con una cuenta registrada.
    • En la tienda física, es obligatorio proporcionar el correo electrónico registrado al momento de pagar. Mamás Mateas no se hace responsable por errores en la entrega de los datos ni por la acumulación de puntos si el correo ingresado es incorrecto.
    • Excepciones: No se acumulan puntos en:
      • Compras pagadas con crédito en tienda.
      • Productos en promoción especial que excluyan el programa de puntos.
    • El cálculo de puntos se realiza sobre el monto total pagado, incluyendo impuestos y costos de envío.

    Multiplicadores de Puntos según Nivel:

    • Basic: 1x (1 punto por cada $1)
    • Pro: 1.1x (10% más puntos)
    • Exclusive: 1.25x (25% más puntos)
    • Signature: 1.5x (50% más puntos)


    4. Uso de Puntos y Canjes

    Los puntos pueden canjearse por:

    • Crédito en tienda (generando códigos de descuento en el portal del Club Mamás Mateas, los cuales deben ingresarse manualmente al pagar).
    • Productos disponibles para canje (según disponibilidad en el portal).

    Conversión de Puntos en Crédito en Tienda:

    • 100.000 puntos = $3.000 de crédito
    • 300.000 puntos = $9.500 de crédito
    • 600.000 puntos = $19.500 de crédito
    • 1.200.000 puntos = $40.000 de crédito
    • 2.000.000 puntos = $70.000 de crédito

    Nota: Los montos pueden cambiar sin previo aviso. Además, Mamás Mateas podrá ofrecer promociones especiales donde se permitan canjes de puntos por productos exclusivos durante eventos o campañas especiales.

    Condiciones del Canje de Productos:

    • Los productos disponibles para canje pueden cambiar sin previo aviso.
    • Mamás Mateas selecciona los productos según disponibilidad y estrategia comercial.

    Condiciones del Crédito en Tienda:

    • Los códigos de descuento tienen una vigencia de 12 meses desde su emisión.
    • Una vez vencido el plazo, los puntos y el crédito expiran sin posibilidad de reactivación.
    • El código debe ingresarse manualmente al pagar.
    • El crédito en tienda no es acumulable con otras promociones y tiene un solo uso. Ejemplo:
      • Si tienes $20.000 en crédito y tu compra es de $100.000, pagarás $80.000.
      • Si tienes $10.000 de crédito y tu compra es de $10.000, pagarás $0, pero el saldo restante no podrá usarse nuevamente.


    5. Cambios y Devoluciones

    • Si una compra es devuelta, los puntos acumulados por esa compra serán descontados en un plazo de hasta 5 días hábiles.
    • Los cambios no generan nuevos puntos; solo se acumulan en la compra original.
    • Si los puntos ya fueron canjeados antes de la devolución, Mamás Mateas podrá:
      • Descontarlos del saldo de la cuenta.
      • Solicitar el reembolso equivalente.
      • Excluir al usuario del programa en caso de fraude.
      • Anular el pedido si se detecta un uso indebido de los puntos.

    Restricción especial: Mamás Mateas se reserva el derecho de anular un pedido realizado con un código de descuento del Club Mamás Mateas si la compra que generó dichos puntos fue realizada en un plazo de 10 días hábiles o menos antes del canje.

    No se acumulan puntos por compras realizadas con crédito en tienda.


    6. Transferencia de Puntos

    • No es posible transferir puntos entre cuentas.


    7. Vencimiento de Puntos y Créditos

    • Los puntos convertidos en crédito en tienda tienen una vigencia de 12 meses desde su emisión.
    • Si no se utilizan dentro de este plazo, expiran sin posibilidad de reactivación.


    8. Exclusión y Cancelación de Cuenta

    Mamás Mateas se reserva el derecho de suspender o cancelar la cuenta de un usuario en caso de:

    • Uso fraudulento del programa (acumulación indebida de puntos o canjes fraudulentos).
    • Intento de transferencia de puntos entre cuentas.
    • Cualquier incumplimiento de estos términos y condiciones.

    Si una cuenta es cancelada, los puntos y créditos acumulados serán eliminados sin derecho a reembolso.


    9. Modificaciones al Programa

    • Mamás Mateas se reserva el derecho de modificar, suspender o cancelar el programa en cualquier momento.
    • Cualquier cambio será comunicado con anticipación a los miembros registrados.

    3. Beneficio para el Usuario y el Referido

    • Usuario que refiere: Recibirá un crédito de $10.000 por cada nuevo cliente que realice una compra válida.
    • Nuevo usuario: Recibirá un descuento de $10.000 en su primera compra de $80.000 o más.
    • Sin límite de referidos: Un usuario puede recibir múltiples créditos de $10.000 cada vez que un nuevo cliente realice su primera compra bajo las condiciones establecidas.
    • Condiciones de uso: El usuario que refiere podrá usar su crédito en compras de $80.000 o más.


    4. Vigencia y Uso de los Beneficios

    • Los créditos y descuentos generados por el Programa de Referidos tienen una vigencia de 30 días desde su emisión.
    • Solo se permite el uso de un cupón de descuento por compra, sin importar la cantidad de cupones acumulados.
    • Los créditos obtenidos no son acumulables con otras promociones o descuentos activos en Mamás Mateas.


    5. Restricciones y Uso Inadecuado

    • No está permitido el auto-referido, es decir, un usuario no puede generar un código de referido para beneficiarse a sí mismo.
    • Está prohibido el uso de prácticas fraudulentas, como la creación de cuentas falsas o la manipulación del sistema para obtener beneficios indebidos.
    • Mamás Mateas se reserva el derecho de cancelar cualquier crédito si detecta actividad fraudulenta o incumplimiento de estos términos.


    6. Problemas con la Acreditación del Beneficio

    Si un usuario que refirió no ve reflejado su crédito en su cuenta, puede deberse a las siguientes razones:

    • El referido no realizó su primera compra: El beneficio solo se aplica en la primera compra del nuevo usuario.
    • No se registró correctamente: El nuevo usuario debe haber completado su registro mediante el enlace de referido al momento de la compra.
    • Compra no válida: Si la compra del nuevo usuario no cumplió con el mínimo requerido de $80.000, el descuento no se activará.

    En caso de dudas o inconvenientes, los participantes pueden contactar al servicio de atención de Mamás Mateas.


    7. Baja del Programa de Referidos

    • Un usuario puede solicitar la cancelación de su cuenta enviando un correo a Mamás Mateas.
    • Al cancelar la cuenta, se perderán todos los puntos y recompensas acumuladas.
    • La participación en el programa podrá retomarse en cualquier momento, pero los beneficios previos no serán recuperables.
    • Para reactivar la cuenta, el usuario deberá ponerse en contacto con los canales de atención de Mamás Mateas.


    8. Modificaciones del Programa

    Mamás Mateas se reserva el derecho de modificar o cancelar el Programa de Referidos en cualquier momento, con o sin previo aviso. Cualquier cambio en los términos será comunicado a los participantes a través de los canales oficiales de la tienda.

    El programa de Baby Shower de Mamás Mateas® está diseñado para premiar a los futuros padres con regalos exclusivos según el monto total de compras realizadas por sus invitados en la lista de baby shower registrada en nuestra tienda.

    Al participar en este programa, el usuario acepta los presentes Términos y Condiciones.

     

    2. Requisitos para Participar

    • La lista de baby shower debe estar creada en Mamás Mateas® y tener un ID válido asignado.
    • Solo las compras realizadas por los invitados a través de la lista de baby shower son consideradas para la acumulación de beneficios.
    • Los montos de compra deben alcanzarse en una misma lista de baby shower, sin posibilidad de combinar diferentes listas.
    • Las compras pueden realizarse tanto en la tienda física como en la tienda online.
      • En tienda física: el invitado debe indicar a nuestra vendedora el ID o nombre de la lista, y los productos comprados serán marcados como adquiridos en la lista.
      • En tienda online: los invitados deben agregar los productos al carrito desde la lista de regalos para que el sistema pueda reconocer la compra, marcar los productos como comprados y asignarlos correctamente a la lista.

    • Las Gift Cards no son acumulables. Se otorgará solo la correspondiente al tramo alcanzado al momento del nacimiento del bebé.


    5. Otras Consideraciones

    • Los regalos y Gift Cards no son canjeables por dinero en efectivo ni por otros productos.
    • Mamás Mateas se reserva el derecho de modificar o cancelar el programa de baby shower en cualquier momento, notificándolo a través de sus canales oficiales.
    • En caso de devoluciones o cancelaciones de compras que afecten los montos acumulados, los beneficios podrán ser ajustados o cancelados según corresponda.
    • Nos reservamos el derecho de cambiar, agregar o eliminar productos o montos de las Gift Cards en cualquier momento.
    • Respecto a nuestro programa de acumulación de puntos Club Mamás Mateas, quien acumula puntos es el usuario utilizado para realizar la compra.
